AGC awaiting court record before deciding on T Nhaveen’s murder case appeal

PUTRAJAYA: The Attorney-General’s Chambers (AGC) will decide whether to proceed with an appeal against the High Court’s decision to acquit five men of the murder of T Nhaveen after receipt of the appeals record, says activist Arun Dorasamy.

He said the AGC’s decision will be made within 10 to 12 days of receipt of the record from the Penang High Court.

“I was told they (the AGC) will assess whether to proceed or not after they have received the appeal record.

“However, I was assured that they will do their level best to proceed,” he told reporters after meeting the AGC’s representative here today.

About 70 people had gathered outside the AGC‘s office to show support for Nhaveen’s mother, Shanti Dorairaj, who was seeking an update of the status of the appeal.

On Oct 13 last year, the AGC confirmed that it had filed a notice of appeal over the five’s acquittal.

The five men, including two who were juveniles at the time they were charged, were acquitted of Nhaveen’s murder by the High Court in George Town earlier that same month.

S Gopinaath, 30, J Ragesuthan, 22, S Gokulan, 22, and the two youths who were charged as juveniles were accused of murdering Nhaveen, then 18, at a park at Jalan Bunga Raya between 11pm and midnight on June 9, 2017.

Lawyer Rajesh Nagarajan said the appeal notice had been served on the five through their lawyers. However, he expressed dissatisfaction with the AGC’s actions.

“Nhaveen’s mother has been asking for updates for the longest time, but there has been no response.

“I have written seven letters requesting updates from the watching brief lawyer to the AGC, but no response was given,” he said.

Rajesh said today’s gathering was necessitated by the AGC’s failure to respond to their queries.
